Well after just under 11,000 miles of pure enjoyment, a vehicle which was stopped at an intersection decided to pull out in front of me. I tried to turn and began to press the binders but too little distance and not enough time. Hit at about 45mph, flew about 15 ft, and broke the other driver's front axle in half.
Lucky to get out of the ER with severe bruises and sprains on my left leg. No broken bones. (All the Gear All The Time :fing02: ).
Just wanted to reinforce the importance of gear and remind everyone to watch out for those cager's! (They never seem to see us)

If my latest experience is anything like yours, you'll find more "issues" than just the left leg over the next few days. Rest up and take it easy OK? :fing02:

Wow, Glad to hear your OK ! May you heel quickly! This happened to me aswell once before a long time ago and the guy sped off never to be found! Hope you get well soon!

Failure to yield to traffic at a stop sign... or something like that. So far the other driver's insurance has accepted 100% liability... Just have to try and get my PCIII off the bike before it is salvaged...

Would HIGHLY recommend. I never ride without a $100 pair of Chinese-leather motorcycle pants. They make the seat more comfortable, grabbing the tank more comfortable, riding in wind more comfortable, riding in cold and rain more comfortable...
What else? Oh yes, they saved me, thick leather and knee protectors are helpful, after my accident, which totalled my bike, I walked away without so much as a sore knee. My knee did hit the ground part hard and slid for a while, but the pants took all the damage and I never would have known. Were you riding with your high beams on? I always do (except at night of course), but I know people who don't. And I can't understand why they'd want to choose the less visible option.
I'm glad you're pretty much ok. Sorry about the bike... Whenever I've crashed, the pain of not being able to ride because my bike was broken always surpassed the pain of my physical injuries.

I dont want to be an ass in your time of trouble but I consider your gear, half gear. Blue jeans, and work boots dont count. I ride in jeans occasionaly so I am just as guilty. I do wear 2 pair of padded MX shorts and knee guards under my jeans.

I'm glad you are ok, glad you were dressed well. I have gotten to where I won't wear the leather pants of my 2-piece, but that may change now.

Nah you're not being an ass... I admit my legs could have been better protected. Almost makes me feel like giving up on using a bike for commuting though. The lesson is, it doesn't matter if you are commuting, going out for a day trip, or riding to your neighbors house... wrap yourself in all the gear head to toe because there are careless drivers out there everywhere. Sorry for the rant.. lots of emotions right now.

Don't let them try to pull that BS on you. Bring your busted up gear to their office and set it down on their desk. Insurance companies will always try to low-ball your nuts off. I wouldn't hesitate to get a lawyer, your rights need to be protected.
oohhh that is a load of SH!T about the gear and accessories. All of my gear was covered no questions asked by the insurance company when i had my t-bone accident. Call your insurance and get them to go after the other company or something. DON'T take no for an answer. Same goes for accessories. Stock or not, it is on the bike. All I had to do was show receipts OR print outs of the items on my bike with prices. Everything was covered.
Oh and if they low ball you on a offer for compensation on the bike, ask them to find that exact bike with exact mods for the price they are trying to give you. That little trick stopped the low ball offer i got on my 98. I also backed it up with similar vfrs in the area and how much was being asked for them. Netted me more money in the end!

That is 100% bullshit. Tell the adjuster to reimburse you for 100% of new replacement cost on these items or you will find an attorney - and follow through. Mention your neck hurts and you are going to the chiropractor you saw a commercial for during daytime TV :491:

As far as proof of ownership, how about the fact that you were wearing them at the time? And why would you need to prove ownership, if you had borrowed someone else's items they'd still have to pay for them.
FWIW, I argued constantly for days with my insurance and was told over and over they were 1000% no way going to pay for stock items, and after pursuing it, I finally got ahold of a manager, and had it taken care of instantly.

My commuting this year has been cut way down. I figure statistically I am increasing my chances of crashing. Also it gets REALLY hot when you are in leather in the summer in a traffic jam. You could call it a diet aid.. lol Last summer I lost 2 pounds from morning to evening many times..
Does the insurance company not realize that without your gear they would be paying for hospital bills right now??? Or a funeral?? Wearing gear is like having air bags, seatbelts, and bumpers. Ohhh that makes me angry!!!

In NY you are covered from dollar #1 for your injuries as well as the property damage. You are looking at a very good settlement amount. You should at least enough $ to get a new VFR1200 plus the money for your bike that was totaled. Don't believe the insurance company - they are in the business of collecting premiums and paying you the absolute smallest amount of money possible. You are not a person who was hurt, you are a claim to be gotten rid of for the lowest possible payment. There is no honor or caring when it comes to an insurance company settling with you. Just dollars and always the smallest number they can get away with. You dodged a bullet there, partner. Inept cagers are everywhere. I was standing on a a parking lot talking to a friend in front of the passenger side of her brand new Toyota just this week. Suddenly, this big behemoth smashes into the the front driver side with incredible force. Missed us by a few feet. A little old lady thought she was hitting the brake but hit the accelerator instead. I rarely use my bikes to commute.

Good points about the hospital bills or funeral costs Nicole, that's an angle I'd be inclined to use to go after reimbursement for the protective gear. The insurance company knows they dodged a bullet and still they try nickle and dime... un F 'ing real!

I don't think you understand they will PAY or you will NOT settle with them. They only have so much time to settle with you. They have to make you whole again or you sue them for more money and win!!becuase by this time pain and suffering has set in and mental problems you've had since almost being killed by their client.
As a person that has been through a similar accident (i.e. other party was cited for negligent driving, their insurance company accepted 100% of the liability) I would definitely recommend what motorhead1977 is saying.
I, however, did not get an attorney involved (although I did receive legal counsel from friends that happen to be attorneys) and spent a great deal of time wrangling with the insurance company to get what was acceptable and adequate compensation from them. What I mean by adequate is that they made me 100% whole to a pre-accident condition. That's the purpose of insurance; otherwise why have it?
If you don't have extra time on your hands, are unskilled at being extremely adamant and/or persuasive, and are unfamiliar with the laws of your state you should seek legal counsel.
Oh yeah, very glad to hear that you came out of it relatively unscathed. The bike, however, looks a bit worse for the wear.

Again my suggestion - you should at least speak with a lawyer so you know your rights and responsibilities. Sign NOTHING - not even endorsing a check for the damage to your bike - until you do so. Give no recorded statements etc as well. The system is a series of deep pitfalls for the very wary. Easiest and best way to be sure, again - consult with a lawyer. She/he is a professional. You went to the doctor for advice/direction on how to handle your injuries. Do the same for yourself on how to handle your claim. They are equally important to you and a mistake in either case will last a long time.
Like Cass and Tim I settled without a lawyer. And like Cass and Tim I wrangled and fought, and wrangled and fought, and wrangled and fought before finally getting reimbursed.
Motorhead has some very excellent points, looking back, it may have been better to get a lawyer just to avoid the hassle.

Ryan's right. You may feel like you don't want to go through the hastle. Don't. Let your insurance people do it for you. If they can screw you they will for a dollar. Several phone calls and photos sent.. yes photo proof of damaged gear and I finally received payment for EVERYTHING I was wearing during the accident. I did not go the lawsuit route but did make a call to find out my rights. I guess I have a new perspective on things and just glad the accident wasn't worse. Thanks for all the advice VFRD!!!
PS after seeing the 7th gen.. I made the choice for more "sport" less "touring." Maybe someday in the future I'll add a 5th or 6th gen to my garage but I have this to play with for now.
